Terms of Use

If translations conflict, the Portuguese version prevails, unless applicable law requires otherwise.

1. Who we are and what these Terms cover

Until Baggagi’s legal entity is formally registered with the competent authorities, the service is provided by:

(“Baggagi”, “we”, or “Provider”).

These Terms of Use (“Terms”) govern access to and use of Baggagi’s website, app, and related services, including AI-assisted travel planning, accounts, saved trips, documents, checklists, chat, events, social feed, payments/subscriptions, and business (B2B) features when available.

By creating an account, accepting at registration, using the service (including limited pre-login use when allowed), or continuing after a change notice, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Baggagi.

When the company is formally incorporated (with a Brazilian CNPJ), these Terms will be updated to name the legal entity as Provider, without reducing essential user rights except where the law requires or allows a proportionate adjustment.

2. Minimum age and eligibility

Baggagi is intended exclusively for people 18 (eighteen) years of age or older.

By using the service or creating an account, you represent and warrant that you are 18 or older and legally able to accept these Terms. False age statements are a violation and may result in suspension or deletion of the account.

3. Account and security

For features that require login, you need a valid account. You are responsible for:

  • providing true and up-to-date information;
  • keeping credentials and device access confidential;
  • all activity on your account, except proven unauthorized use without your fault after timely notice to us.

Login may use an identity provider (e.g. Google / Neon Auth). That provider’s rules also apply to authentication.

We may refuse, suspend, or terminate accounts for Terms violations, security risk, fraud, abuse, or legal requirements.

4. Service description

Baggagi offers, subject to availability and plan:

  • generation and editing of travel itineraries (including AI assistance);
  • saving, sharing, and collaborating on trips;
  • checklists and document uploads linked to trips;
  • social and communication features (profile, posts, chat, events), when enabled;
  • free and paid plans (subscription) processed by third parties (e.g. Stripe);
  • agency/business features when contracted.

We do not guarantee uninterrupted availability, error-free operation, or that the service will meet every specific need. Features may be subject to feature flags, usage limits, maintenance, or reasonable discontinuation, with notice when materially relevant.

Pre-login use (e.g. generating/exploring an itinerary without an account) is limited; saving and using persistent features requires registration and acceptance of these Terms.

5. AI-generated content and travel notices

Itineraries, suggestions, estimated costs, schedules, activities, meals, and other AI-assisted content are informational and approximate.

They are not:

  • legal, medical, safety, financial, or professional advice;
  • a guarantee of prices, availability, schedules, weather, visas, vaccines, transport, lodging, or any real-world travel condition.

You must verify critical information with official sources and real providers before traveling or booking. Baggagi is not liable for decisions, bookings, expenses, or losses arising from exclusive reliance on content generated or suggested by the platform.

6. Your content and conduct

You may submit, create, or share content (text, images, documents, messages, posts, events, etc.) (“User Content”).

You represent that you have rights to that content and that it does not violate law, third-party rights, or these Terms. You remain the owner of User Content and grant Baggagi a worldwide, non-exclusive, royalty-free license, transferable only as needed to host, store, display, transmit, back up, and operate the service (including sharing you authorize).

Prohibited conduct includes, among others:

  • using the service for unlawful, fraudulent, or abusive purposes;
  • harassing, threatening, discriminating against, or exploiting others;
  • posting illegal, defamatory, or obscene content, or content that violates privacy/IP;
  • sending malware, spam, unauthorized scraping, or attempting to bypass security/limits;
  • misrepresenting identity, age, or affiliation;
  • using third-party data without a legitimate basis;
  • interfering with the service or other users.

We may remove content, limit features, or terminate accounts that violate these rules, without prejudice to legal remedies.

7. Collaboration, sharing, and social features

When you share a trip, invite participants, make a profile public, publish posts, or join events/chat, you understand that other users may see what the feature and your settings allow.

You are responsible for choosing appropriate permissions and for content you share. Baggagi does not fully control third-party conduct on the platform.

8. Documents and files

Uploaded files (trip documents, avatars, etc.) are your responsibility as to legality and necessity. Do not upload unnecessary documents, excessive third-party data, or content you lack rights to store/share.

Technical limits apply (e.g. max upload size). We may refuse or remove files that violate these Terms or present a security risk.

9. Plans, payments, and cancellation

Paid plans and charges are processed by Stripe (or another indicated processor). By subscribing, you also agree to the processor’s terms.

  • Prices, billing cycles (monthly/annual), and benefits appear in the checkout/plan UI at purchase time.
  • Except for applicable cooling-off/cancellation rights or a different commercial policy published at purchase, processed charges follow the processor and plan rules.
  • Premium access depends on payment confirmation (e.g. webhook). A success redirect alone does not guarantee activation.
  • We may change prices or plans with reasonable prior notice for future periods; changes will not improperly affect already-paid periods to the extent required by law.

10. Baggagi intellectual property

Brand, layout, software, databases, institutional texts, design, and other Baggagi elements (except User Content and third-party content) belong to the Provider or its licensors.

You may not copy, modify, distribute, reverse engineer, or commercially exploit the service or its elements without prior written permission, except normal use allowed by the platform.

You may export (e.g. PDF) generated/edited itineraries for personal or legitimate professional use related to your trip, without acquiring rights in the platform itself.

11. Third-party services

Baggagi integrates or links to third-party services (authentication, payments, maps, storage, e-mail, analytics, etc.). Those services have their own terms and policies. We are not responsible for failures, policies, or acts of those third parties beyond our reasonable control.

12. Privacy and data protection

Personal data processing follows the Privacy Policy and Brazil’s LGPD. By using the service, you acknowledge that Policy.

13. Disclaimers and limitation of liability

To the maximum extent permitted by applicable Brazilian law (including the Consumer Defense Code when it applies):

  • the service is provided “as is” and “as available”;
  • we do not guarantee specific travel outcomes, savings, destination safety, or fitness for a particular purpose;
  • we are not liable for indirect damages, lost profits, data loss (beyond what our measures reasonably prevent), or losses from force majeure, third-party acts, or improper use;
  • our total aggregate liability, when applicable, is limited to amounts you paid Baggagi in the 12 (twelve) months before the event, or BRL 500.00 if there was no payment — whichever is greater — except for willful misconduct, gross negligence, or cases where the law forbids limitation.

Nothing in these Terms excludes non-waivable consumer rights.

14. Suspension, termination, and deletion

You may stop using the service and request account deletion as described in the Privacy Policy and indicated channels.

We may suspend or terminate access, in whole or in part, for violations, risk, relevant prolonged inactivity, service discontinuation, or legal order, preferably with notice when reasonable and legally allowed.

Provisions that by nature should survive (IP, limitations, applicable indemnities, governing law) remain after termination.

15. Changes to these Terms

We may update these Terms to reflect product, legal, or provider changes. The “Last updated” date will be revised. For material changes we may notify by e-mail, in-product notice, or another reasonable means.

Continued use after the new version takes effect, when allowed, means acceptance; when the law requires new consent, we will request it.

16. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil.

The venue is the consumer’s domicile court when the CDC applies; otherwise, the Provider’s domicile court, subject to mandatory jurisdiction rules.
